In which cases are those who refuse to pay exempt from doing so?
Dissenting owners are not required to pay when the replacement is not necessary for the operation of the service. That is, if the expense is used to cover an improvement not required for the proper conservation, habitability and safety of the property, or, in accordance with the provisions of article 11 of the Horizontal Property Law (LPH) , when the cost exceeds the amount of three ordinary monthly payments of common expenses.

In hydraulic lifts, it is mandatory for the door to be closed when the lift is stopped at the landing. This lift is probably electric, and this is not mandatory. In any case, if you are interested in having the door closed, you should ask the company that maintains your lift.

The dimensions of the elevator cabin are determined by the EN 81.2 standard, which indicates the minimum and maximum cabin dimensions that can be established. Cabin dimensions also vary depending on whether the building is new or renovated.
In renovations, it may happen that the new cabins have slightly smaller dimensions than the old ones, this is due to the installation of doors in the cabin.
In the case you are describing, you should contact the lift technician who carried out the renovation to report this situation and see what solution they can provide, since all installations have a technical file with their characteristics that is certified by a notified body as complying with current law.

At the national level, through the “2011 Renovation Plan for Residential Buildings” grants of up to €3,300 per elevator are currently being awarded. The requirement is that the improvement of the service means a reduction in energy consumption of at least 35% and that this amount does not exceed 35% of the budget.
In addition to the Renove Plan, the Government also offers other types of aid such as:
• State Housing and Rehabilitation Plan 2009-2012
• Deduction in personal income tax for home improvement works
• 8% VAT for home improvement works

In order to give you a definitive answer, we would need more information about the installation; mainly, the type of door/s installed (automatic in the cabin and landing, semi-automatic in the landing and without door in the cabin, telescopic in the landing and in the cabin, etc.). To help you resolve the problem, it is also necessary to know if it is the cabin door (if it has one), or the exterior door (landing).
The most common type of lift installation is to install doors only on landings. If this door is semi-automatic (swinging), it must always remain closed except during loading and unloading. If the door is open, the lift does not respond to calls and can therefore only be used from the floor on which it is located. This type of door has a semi-automatic closing system that prevents it from being left open.
Alternatively, manual doors may be installed; if this is the case, the user must ensure that the doors are closed after using the lift, ensuring that it is ready for future use.
Regarding the obligation (by law) for these to remain closed, the Machinery Directive 2006/42/EC, which controls the requirements for this type of lift, does not explicitly state that these doors must remain closed when the lift is stopped because it does not represent a risk for users. On the other hand, as I mentioned earlier, it is necessary for the doors to remain closed so that the lift can handle calls from other floors. In the case of a lift for people with reduced mobility, it is mandatory for the landing doors to close automatically.

In the building we have 3 commercial premises, and a 4th commercial premises within the building without access to the lift, on the first floor. Hello, I need advice on raising the elevator in the community of owners where my mother lives, she is 70 years old, she is retired and the owner of the house, she has a disability of more than 33%. The elevator in the house goes from the ground floor to the 5th floor but does not go up to the 6th floor, which is where my mother lives, instead there is the machinery.
